Letting in Tenerife from abroad

Tenerife has two rental markets. Santa Cruz and La Laguna are residential, with long-term demand from civil servants and health workers. On the south coast, from Costa Adeje to Los Cristianos, many apartments belong to owners in the UK and the rest of Europe, and hotel workers look for long-term homes nearby.

What the management includes

  • Listing, solvency checks and debtor-register searches
  • Tenancy agreement drafted by the firm, with an inventory
  • Deposit lodged with the regional government within one month (Law 2/2014, art. 2)
  • Rent collection, payment control and periodic reports
  • Repairs through contractors on the island
  • Form 210 returns for non-resident owners
  • Arrears claim and eviction, with no additional fees from the firm

If the tenant stops paying in Tenerife

The firm acts from the first missed payment. If the debt is not settled, it claims eviction and the rent owed before the Civil Section of the Tribunal de Instancia of the judicial district where the flat is (art. 52.1.7.º of the Civil Procedure Act, LEC), or before its single section where the court has no separate sections (art. 84 of the Judiciary Act, LOPJ).

  1. Formal demand

Sent by burofax or another reliable means at least 30 days before filing. If the debt is still unpaid on the day the claim goes in, the tenant can no longer rely on the ordinary right to halt the eviction by paying.

    Art. 22.4 LEC

  2. Out-of-court attempt

Before filing, the firm makes and records the attempt to settle out of court that the law requires for the claim to be admitted.

Art. 5 of Organic Law 1/2025

  3. Claim and ten-day requirement

Eviction and rent are claimed together in a verbal trial. The tenant then has ten days to leave, pay or oppose; otherwise, the eviction goes ahead on the date already set.

    Arts. 250.1.1.º and 438.5 LEC

No additional fees from the firm; third-party costs such as the procurador, when mandatory (art. 23 LEC), are set out in the proposal. Guide: Tenant not paying in the Canary Islands.

Tax on your Tenerife rent if you live abroad

Spain taxes your rent through non-resident income tax (IRNR) on form 210, which the firm files:

  • EU residents, for example in Germany, the Netherlands, Sweden or Denmark, pay 19% on the net rent, after deducting the expenses directly related to the letting. Residents of an EEA state such as Norway are treated the same way only if that state has an effective exchange of tax information with Spain (arts. 24.6 and 25.1.a of the Non-Residents’ Income Tax Act, TRLIRNR).
  • UK residents, like everyone outside the EU and the EEA, pay 24% on the gross rent, with no expenses deducted (arts. 24.1 and 25.1.a TRLIRNR).
  • From the last quarter of 2026, rental income with tax to pay is declared once a year, from 1 to 20 April of the following year (art. 5 of Order EHA/3316/2010, as amended by Order HAC/623/2026).

Your home country may also tax it; the double taxation treaty decides how the Spanish tax is credited. Guide: Rental income tax for non-residents in Spain.

Holiday lets in Tenerife: complying with Law 6/2025

A tourist let follows Canary Islands Law 6/2025: the town plan must expressly allow tourist use of the home (art. 3.3), and before the first guest a responsible declaration is filed with the Cabildo de Tenerife, with a planning certificate and, in a community of owners, the community’s certificate (arts. 7.1 and 7.7).

Many south-coast apartments are in complexes: if the complex was configured as a tourist establishment, its units are not homes and cannot become holiday homes (art. 5.1.c). Every advert needs the registration number (art. 8.6): publishing one without it can cost €30,001 to €300,000 in fines (arts. 75.16 and 79.2.c of Law 7/1995). The firm checks this before you decide.

  • Free initial assessment, without obligation
  • No additional fees from the firm for the arrears claim and the eviction

IGIC, the Canary Islands’ indirect tax, applies to the fees at the general rate of 7% (art. 51.1.d of Canary Islands Law 4/2012). Full fee table, in Spanish: tarifas de la gestión de alquileres.

Questions from owners in Tenerife

I live in the UK. Can you manage my flat in Tenerife?

Yes. The firm manages the let remotely and files your form 210. As a UK resident, you pay 24% on the gross rent, with no deductions.

How long does an eviction take in Tenerife?

It depends on the court’s workload, on whether the tenant opposes and on the tenant’s circumstances, so the firm does not promise a timeframe. What it controls is acting from the first missed payment.

Why does a firm in Las Palmas manage lets in Tenerife?

Most of the work is digital, contractors on the island carry out repairs, and the firm travels to Tenerife for hearings.

Does the firm offer guaranteed rent?

No, and it does not advance rent payments either. It acts from the first missed payment, and the arrears claim and the eviction carry no additional fees from the firm.
