The local market

One island, two rental markets

Residential, all year

Las Palmas de Gran Canaria

Civil servants, health workers, students and service workers keep long-term demand steady all year. With many applicants per listing, the risk lies in choosing the tenant: the firm checks income and searches debtor registers first.

Evictions: Civil Section of the Tribunal de Instancia (court of first instance) of Las Palmas de Gran Canaria, near the firm’s office.

Tourist south

The south: Maspalomas, Playa del Inglés, San Agustín and Mogán

Holiday apartments and owners abroad set the tone; tourism workers look for long-term homes near their jobs. Units in a complex set up as a tourist establishment are not homes and cannot become holiday lets (art. 5.1.c of Canary Islands Law 6/2025); whether one can be let long term depends on its title and the town plan, which the firm checks first.

Evictions: Tribunal de Instancia of San Bartolomé de Tirajana, which also covers Mogán.

Non-payment

What happens if your tenant stops paying?

The lawyer who manages your let runs the case. The law sets the steps; the total time depends on the court’s workload, any opposition and the tenant’s circumstances, so the firm promises no duration.

  1. Formal demand

A demand by a verifiable means, such as burofax, at least 30 days before filing: if the rent is still unpaid at filing, the tenant loses the ordinary right to stop the eviction by paying.

    Art. 22.4 LEC

  2. Attempt to settle

The claim is only admitted after an out-of-court attempt to settle, which the firm makes and documents.

Art. 5 of Organic Law 1/2025

  3. Claim for eviction and rent

Both can be claimed together, in a summary procedure (juicio verbal) before the court where the property is. The claim says whether the home is the occupant’s main home and whether you are a large landlord (gran tenedor); if not, it includes a Land Registry certificate of your properties.

    Arts. 52.1.7.º, 250.1.1.º and 439.6 LEC

  4. Ten-day notice

The court clerk gives the tenant ten days to leave, pay or oppose, and sets the hearing and eviction dates. If the tenant does nothing, a decree ends the case and the eviction takes place on that date.

    Art. 438.5 LEC

Law 6/2025

Can you let your apartment to tourists?

Holiday rental licence in the Canary Islands

Compliance comes first. Before the first guest, a responsible declaration (declaración responsable) goes to the Cabildo de Gran Canaria with a technical report, the community’s certificate where relevant and a planning certificate (cédula urbanística) showing that the town plan expressly allows tourist use (arts. 7.1 and 7.7 of Law 6/2025).

As a rule the home must be at least ten years old (art. 5.1.a), and every listing must show the registration number (art. 8.6); advertising without it can be fined €30,001 to €300,000 (arts. 75.16 and 79.2.c of Canary Islands Law 7/1995). If it cannot qualify, the firm can manage a long-term let.

Tax and fees

What tax and fees apply?

Non-resident owners

  • Resident in another EU state, or an EEA state with an effective exchange of tax information: 19% non-resident income tax (IRNR) on the net rent, after the expenses directly linked to the let. Elsewhere, such as the United Kingdom: 24% on the gross rent (arts. 24.6 and 25.1.a of the IRNR Act).
  • Form 210 with tax to pay is filed once a year, from 1 to 20 April of the following year, for rent from the last quarter of 2026 onwards (Order HAC/623/2026). The firm files it.

Published fees

  • Long-term let: from 8% to 12% of the monthly rent, depending on the property and the services.
  • Holiday let: from 15% to 25% of income.
  • Initial assessment: free and without obligation.

The fees are subject to IGIC at the general rate of 7% (art. 51.1.d of Law 4/2012). If the tenant stops paying, the arrears claim and the eviction are included, with no additional fees from the firm; third-party costs, such as the procurador when their involvement is mandatory, are set out in the proposal. Frequently asked questions

Questions from owners in Gran Canaria

Which court hears an eviction in Gran Canaria?

The Tribunal de Instancia of the judicial district where the property is (art. 52.1.7.º LEC): Las Palmas de Gran Canaria for the capital; San Bartolomé de Tirajana for Maspalomas, Mogán and Vecindario; Telde for Telde, Ingenio and Agüimes; Arucas; and Santa María de Guía for Gáldar. Elsewhere, the firm confirms it.

Can my apartment in Maspalomas or Puerto Rico be let to tourists?

Only if the town plan expressly allows tourist use for it, the community of owners does not rule it out and the complex is not a tourist establishment (arts. 5.1.c and 7.7 of Law 6/2025). The firm checks this first and compares it with a long-term let.

I live in the UK. How much tax do I pay on rent from Gran Canaria?

24% of the gross rent, with no deductions, on form 210 (art. 25.1.a of the IRNR Act); EU residents pay 19% on the net rent. Your country of residence may also tax it: ask your adviser there.

Who lodges the tenant’s deposit?

The firm does. In the Canary Islands the landlord must lodge an amount equal to the deposit with the regional government within one month of the contract, even if the tenant paid none (art. 2 of Canary Islands Law 2/2014). At the end, the firm requests its return.
