Frequently asked questions
Do you speak English?
Yes. Our team handles family law cases for English-speaking clients across the Canary Islands. We prepare documents bilingually when needed and accompany you to hearings with interpretation. We also work with German and Dutch-speaking clients.
I'm a British citizen — can I still use Spanish courts after Brexit?
Yes. Brexit did not remove the right of British nationals to use Spanish courts. Spanish courts have jurisdiction if you reside in the Canary Islands. Cross-border enforcement of rulings between UK and Spain is now governed by domestic law rather than EU regulations.
My partner wants to take our children back to their home country. What can I do?
Act immediately. Spain is a signatory to the Hague Convention on Child Abduction (1980). We apply urgently to the Spanish courts and coordinate with Central Authorities in both countries. Delays significantly reduce the chances of a return order.
Can I make a Spanish will for my property in the Canary Islands?
Yes, and it is strongly recommended. Under EU Succession Regulation 650/2012, EU citizens can choose whether their estate is governed by their nationality law or residency law. A Spanish will avoids lengthy and expensive probate for your heirs.
